DOMUS S.r.l. is the manufacturer and owner of the Domus Home Collection brand and is the owner of the rights of use on domains, logos, trademarks, copyrights applied to the Site.

 

Scope of application and conclusion of the contract

1.1. Any information contained on the Site does not constitute a binding offer to sell products in any country or location.

1.2. The offer and sale on the Product Site constitute an online contract, governed by Legislative Decree 9 April 2003, n. 70, containing the discipline of electronic commerce. The Site is reserved for wholesale sales. DOMUS S.r.l., therefore, offers for sale the Products exclusively to Customers who have the quality of "Professional". Pursuant to art. 3, I comma, lett.c) of the Consumer Code, "Professional" is the natural or legal person who acts in the exercise of his / her entrepreneurial, commercial, craft or professional activity, or an intermediary. 1.5. The applicable General Conditions of Sale are those in force on the date of transmission of the purchase order. They can be changed at any time. Customers are therefore invited to access the Site by checking the General Conditions of Sale before proceeding with the purchase.

ORDER NUMBER: unique identification number of the order, automatically generated following the completion of the procedures for sending the order form by the Customer.

EMAIL "Problematic Communication Order Fulfillment": email with which DOMUS srl communicates to the Customer the impossibility of fulfilling the order within the term of 30 days.

EMAIL "CANCELLATION OF ORDER FOR LACK OF PAYMENT": email with which the seller communicates the non-receipt by bank transfer of the amount due by way of payment within the set terms and the termination of the contract pursuant to art. 1456, cc

 

Purchases on the Site

2.1. The purchase of the Products on the Site can only be made through registration.

Registration allows customers to perform the following activities on their Personal Area:

- Consult the status of your order online and check the "history" of orders already placed

- Manage your delivery addresses by speeding up the insertion of new orders

- Manage your payment methods

- Manage your customer registry

2.2. The Site is constantly updated automatically in order to ensure maximum correspondence between the availability communicated by the suppliers and those indicated on the Site. (See paragraph "product availability").

Direct information for the conclusion of the contract

3.1. In accordance with Legislative Decree 9 April 2003, n. 70 containing provisions on electronic commerce, DOMUS S.r.l. informs the Customer that:

- to make the purchase of one or more Products on the Site, the Customer must first authenticate himself with the credentials selected by him at the time of registration;

- fill out an order form in electronic format and transmit it to DOMUS S.r.l. , electronically, following the instructions that will appear from time to time on the Site;

- before proceeding with the transmission of the order form, the Customer can identify and correct any errors in data entry by following the instructions indicated on the Site from time to time, which will accompany the various stages of the purchase, and accept the General Conditions of Sale;

- once the order form has been registered, DOMUS S.r.l. will send to the Customer's E-mail address an "Automatic Order Receipt Confirmation" e-mail containing: information relating to the essential characteristics of the product purchased, detailed price indication, the means of payment used, delivery costs and any additional costs.

- the order form will be filed in the DOMUS S.r.l. database for the time necessary to execute it and, in any case, in accordance with the law. To access their order form, the customer can follow the procedure referred to in article 7.2 below.

3.2. The language available to customers for the conclusion of the contract is Italian and English. The product catalog is available in Italian, English, French and Spanish.

 

Availability of Products

4.1. Due to simultaneous purchases on the Site, it is possible, for technical reasons, that the Product, even if reported as available, is not immediately available after the transmission of the order and that it is, therefore, necessary to wait for the restocking for it.

4.2 In case of temporary unavailability of the ordered Product, the Customer will be notified immediately, in any case within twenty days from the transmission of the order, with the e-mail called "Problematic Communication for Order Fulfillment" where the new possible delivery term is indicated. for the seller.

The customer will have the right to withdraw from the contract within five days of sending the aforementioned communication. If the right of withdrawal was not exercised, the new delivery term will be considered accepted and the shipment will still take place within the deadline indicated in the email "Problematic Communication of Order Fulfillment".

The seller reserves the right to insert a replacement product immediately available in the "Problematic Communication Order Fulfillment" email. In this case, the Customer will have the right to accept the replacement, to be communicated to DOMUS S.r.l. through the methods indicated in the above-mentioned email, within 5 days of receipt of the same.

In the event that the Customer opts for the withdrawal, or if the replacement proposal is not accepted, DOMUS S.r.l. will immediately refund the total amount paid for the order (see the following paragraph: "Payment Method").

4.3 In the case of absolute unavailability of the ordered Product, the Customer will be promptly informed, in any case within twenty days from the transmission of the order, by email "Problematic Communication of Order Fulfillment".

The seller reserves the right to insert a replacement product in the "Problematic Communication Order Fulfillment" email. In this case, the Customer will have the right to accept the replacement, to be communicated to DOMUS Srl through the methods indicated in the above-mentioned email, within 5 days of receipt of the same.

In the event that the Customer opts for immediate termination, or if the replacement is not accepted within the deadline, the purchase order will be canceled, the contract terminated, and to the Customer who has already made the payment (see section Payment), the total amount paid will be promptly refunded, including delivery costs and any other costs incurred, in relation to the order itself.

4.4 Any negotiations between the Parties as a result of the cases of temporary and/or definitive unavailability regarding the new delivery terms and replacement products are reserved provided that they take place within the time limits and according to the rules outlined in this contract and in particular by articles 4.2 and 4.3. 1.7 and 1.8.

 

Product information

5.1. The characteristics of each product are defined in the "Product Page". DOMUS S.r.l., reserves the right to modify the Product Page, without any prior notice.

5.2. DOMUS S.r.l. will do its best to ensure that the images of the Products published on the Site, which can also be viewed on the Product Page, represent as faithfully as possible the Products offered for sale. The colors of the Products, however, may differ from the real ones due to the settings of the IT systems or computers used by users for their display.

5.3. For the purposes of the purchase contract, the description of the product contained in the order form sent by the Customer will prevail.

 

Prices

6.1. All prices published on the Site are in Euros and are not inclusive of VAT.

6.2. DOMUS S.r.l. reserves the right to change the price of the Products at any time. It is understood that the price of the Product that will be charged to the Customer will be the one indicated on the Site at the time of the order and that any changes (increasing or decreasing) subsequent to the transmission of the same will not be taken into account.

 

Purchase orders

7.1. In the e-mail of "Automatic Order Receipt Confirmation", in addition to the content referred to in article 3.1 above, the Customer will also find an indication of the "Order Number", which he must then use in any subsequent communication with DOMUS S.r.l., as well as the summary of all customer data entered in the order. 7.2 The Customer who made the purchase will be able to check the status of the orders already concluded on the Order History of his Personal Area.

7.3. DOMUS S.r.l. reserves the right to refuse orders that come from:

- by a customer with whom it has a legal dispute in progress;

- by a customer who previously violated the conditions and/or terms of the purchase contract with DOMUS S.r.l.;

- DOMUS S.r.l. also reserves the right to refuse orders from customers who have issued false, incomplete or in any case incorrect identification data.

 

Terms of payment

8.1 The payment of the Products purchased on the Site can be made in two ways: PayPal payment or Manual payment.

8.1.1 Manual payment is made by advance bank transfer. The payment of the relative amount by bank transfer must be made to the coordinates specified below:

8.1.2 Payment by advance bank transfer must be received no later than five working days from the date of sending the e-mail "Automatic Order Receipt Confirmation". Once this term has passed unnecessarily, the contract will be terminated pursuant to art. 1456 of the Italian Civil Code and DOMUS Srl will notify the Customer without delay of the resolution via the "Cancellation of Order for Lack of Payment" email if he intends to use it.

8.1.3 In the case of payment by advance bank transfer, the terms for delivery of the goods will start from the date of receipt of payment by DOMUS S.r.l. and not from the date of transmission of the order.

8.1.4 To facilitate the connection between the payment received by bank transfer and the order made, the Customer must indicate in the purpose of the bank transfer:

- the Order Number;

- the date of placing the order;

- the name and surname of the holder of the order, if different from that of the holder of the current account from which the transfer originates.

8.2 Another method of payment is via PayPal.

8.2.1 Payment by the buyer directly on the Site can be made through PayPal.

8.2.2 When registering the Customer on the Site, the User will be asked to enter his VAT number as proof of identity, of reaching the age of majority and of his quality as a Professional. The Seller is not responsible for any delays in processing payments and transactions through the aforementioned systems.

8.2.3 the Customer, who has chosen PayPal as the payment method, is required to ensure that the PayPal account is active and has sufficient liquidity to complete the transaction. Any costs due to a refusal of the transaction will be exclusively borne by the customer.

8.2.4 DOMUS S.r.l. reserves the right to request payment of the price directly from the Customer if the same is not received through the PayPal method.

 

Methods, expenses, delivery terms and transport damages

9.1 To carry out the delivery to the Customer, DOMUS S.r.l. makes use of the courier service providers identified from time to time by Eurosender SARL.

9.2 Delivery costs are charged to the Customer as reported in the Checkout Form.

9.3 The delivery of all Domus S.r.l. products take place within and no later than 30 days from the date of receipt of payment by DOMUS S.r.l., without prejudice to the provisions of the above provisions "Product Availability" and clause 8.1.3.

9.4 The Customer is aware that the Seller has no control over shipping and transportation and is unable to provide, nor does he assume any responsibility or commitment to provide compensation for facts attributable to shipping and transportation.

11.4 Waivers: Any failure or late implementation (in whole or in part) of any provision of these Regulations cannot be interpreted as a waiver by one or the other party to assert their rights or remedies.

11.5 Assignment: the user of the Site cannot assign any rights or obligations provided for in these Regulations without the prior written consent of the Seller. The Seller can assign any right or obligation provided for in this document to a company affiliated with it or to any company with which it associates to carry out the business activity, which it acquires or to which it is sold.
